第一章

Chapter 1 General Provisions

第一條   為了規範行政處罰的設定和實施,保障和監督行政機關有效實施行政管理,維護公共利益和社會秩序,保護公民、法人或者其他組織的合法權益,根據憲法,制定本法。

Article 1 Pursuant to the Constitution, this Law is enacted for the purpose of standardizing creation and imposition of administrative penalty, ensuring and supervising the effective exercise of administration by administrative organs, safeguarding public interests and social order, and protecting the lawful rights and interests of citizens, legal persons and other organizations.

第二條   行政處罰的設定和實施,適用本法。

Article 2 The creation and imposition of administrative penalties shall be governed by this Law.

第三條   公民、法人或者其他組織違反行政管理秩序的行為,應當給予行政處罰的,依照本法由法律、法規或者規章規定,並由行政機關依照本法規定的程序實施。

Article 3 Where an administrative penalty needs to be imposed on a citizen, legal person or any other organization in relation to a violation of an administrative regulation, it shall be prescribed by the laws, rules or regulations pursuant to this Law, and imposed by administrative organs in compliance with the procedure prescribed by this Law.

沒有法定依據或者不遵守法定程序的,行政處罰無效。

Administrative penalties imposed without legal basis or observance of legal procedures shall be null and void.

第四條   行政處罰遵循公正、公開的原則。

Article 4 Administrative penalties shall be imposed in adherence to the principles of fairness and openness.

設定和實施行政處罰必須以事實為依據,與違法行為的事實、性質、情節以及社會危害程度相當。

The creation and imposition of administrative penalties shall be based on the facts of the case and shall correspond to the facts, nature and gravity of the violation and damage done to society.

對違法行為給予行政處罰的規定必須公布;未經公布的,不得作為行政處罰的依據。

Regulations on administrative penalties to be imposed for violations of the law must be published; those which are not published shall not be used as the basis for an administrative penalty.

第五條   實施行政處罰,糾正違法行為,應當堅持處罰與教育相結合,教育公民、法人或者其他組織自覺守法。

Article 5 In imposing administrative penalties, penalties shall also be educational in nature, so that citizens, legal persons and other organizations can become aware of and understand the importance of observing the law.

第六條   公民、法人或者其他組織對行政機關所給予的行政處罰,享有陳述權、申辯權;對行政處罰不服的,有權依法申請行政複議或者提起行政訴訟。

Article 6 Citizens, legal persons and other organizations on whom administrative penalties are imposed by administrative organs shall have the right to state their case and the right to defend themselves; those who refuse to accept administrative penalties shall have the right to apply for administrative reconsideration, or bring an administrative lawsuit in accordance with the law.

公民、法人或者其他組織因行政機關違法給予行政處罰受到損害的,有權依法提出賠償要求。

Citizens, legal persons and other organizations that have suffered damage caused by an administrative penalty imposed by an administrative organ in violation of the law shall have the right to demand compensation in accordance with law.

第七條   公民、法人或者其他組織因違法受到行政處罰,其違法行為對他人造成損害的,應當依法承擔民事責任。

Article 7 Citizens, legal persons and other organizations that are subject to administrative penalties because of a legal violation shall, in accordance with the law, bear the civil liability for the damage done to others by their unlawful act.

違法行為構成犯罪,應當依法追究刑事責任,不得以行政處罰代替刑事處罰。

Where an illegal act constitutes a crime, criminal responsibility shall be investigated in accordance with law; no administrative penalty shall be imposed in the place of criminal penalty.

第二章 行政處罰的種類和設定

Chapter 2 Types and Creation of Administrative Penalties

第八條   行政處罰的種類:

Article 8 Types of administrative penalties shall include:

(一)警告;

1. Warning;

(二)罰款;

(II) Fine;

(三)沒收違法所得、沒收非法財物;

(III) Confiscation of illegal gains or property;

(四)責令停產停業;

(IV) Order of suspending production and business;

(五)暫扣或者吊銷許可證、暫扣或者吊銷執照;

(V) Suspension or withdrawal of permits, Suspension or withdrawal of licenses;

(六)行政拘留;

6. administrative detention; and

(七)法律、行政法規規定的其他行政處罰。

(VII) Other administrative punishments provided for by laws and administrative regulations.

第九條   法律可以設定各種行政處罰。

Article 9 Different types of administrative penalties may be created by law.

限制人身自由的行政處罰,只能由法律設定。

Administrative punishment restricting personal freedom can only be set by law.

第十條   行政法規可以設定除限制人身自由以外的行政處罰。

Article 10 Administrative penalties, with the exception of restricting the freedom of the person, may be created through administrative rules and regulations.

法律對違法行為已經作出行政處罰規定,行政法規需要作出具體規定的,必須在法律規定的給予行政處罰的行為、種類和幅度的範圍內規定。

Where it is necessary to formulate specific provisions, in administrative rules and regulations, regarding violations of law for which administrative penalties have been formulated in laws, it must be done within the limits of the acts subject to administrative penalty and the types and range of such penalty as prescribed by laws.

第十一條   地方性法規可以設定除限制人身自由、吊銷企業營業執照以外的行政處罰。

Article 11 Administrative penalties, with the exception of restrictions on the freedom of the person and the rescission of business licenses of enterprises, may be created by local regulations.

法律、行政法規對違法行為已經作出行政處罰規定,地方性法規需要作出具體規定的,必須在法律、行政法規規定的給予行政處罰的行為、種類和幅度的範圍內規定。

Where it is necessary to formulate specific provisions, in local regulations, regarding violations of law for which administrative penalties have been formulated in laws and administrative rules and regulations, it must be done within the limits of the acts subject to administrative penalty and the types and range of such penalty as prescribed by laws and administrative rules and regulations.

第十二條   國務院部、委員會制定的規章可以在法律、行政法規規定的給予行政處罰的行為、種類和幅度的範圍內作出具體規定。

Article 12 The ministries and commissions under the State Council may, in the rules they enact, formulate specific provisions that are within the limits of the applicable laws dealing with administrative penalties and in accordance with the types and range of the penalties that have been prescribed by laws and administrative rules and regulations.

尚未制定法律、行政法規的,前款規定的國務院部、委員會制定的規章對違反行政管理秩序的行為,可以設定警告或者一定數量罰款的行政處罰。罰款的限額由國務院規定。

With regard to violations of administration order against which no laws or administrative rules and regulations have been enacted, the ministries and commissions under the State Council may create administrative penalties that serve as disciplinary warnings, or institute fines, as stipulated in the preceding paragraph. The specific amounts of fine shall be laid down by the State Council.

國務院可以授權具有行政處罰權的直屬機構依照本條第一款、第二款的規定,規定行政處罰。

The State Council may authorize the departments directly under it that have the power to administer administrative penalties to formulate provisions regarding administrative penalties in accordance with the first and second paragraphs of this Article.

第十三條   省、自治區、直轄市人民政府和省、自治區人民政府所在地的市人民政府以及經國務院批準的較大的市人民政府制定的規章可以在法律、法規規定的給予行政處罰的行為、種類和幅度的範圍內作出具體規定。

Article 13 The people's governments of all provinces, autonomous regions, and municipalities directly under the Central Government, cities where the governments of provinces and autonomous regions are located, and the large cities approved by the State Council may, within the limits of the applicable laws dealing with administrative penalties and in accordance with the types and range of the penalties that have been prescribed by laws and administrative rules and regulations, formulate specific provisions and rules regarding administrative penalties.

尚未制定法律、法規的,前款規定的人民政府制定的規章對違反行政管理秩序的行為,可以設定警告或者一定數量罰款的行政處罰。罰款的限額由省、自治區、直轄市人民代表大會常務委員會規定。

With regard to violations of administration order against which no laws or regulations have been enacted, the people's governments may create administrative penalty of disciplinary warning or certain amount of fine in the rules they enact, as stipulated in the preceding paragraph. The specific amounts of fine shall be laid down by the standing committees of the people's congresses of provinces, autonomous regions, and municipalities directly under the Central Government.

第十四條   除本法第九條、第十條、第十一條、第十二條以及第十三條的規定外,其他規範性文件不得設定行政處罰。

Article 14 No administrative penalties shall be created in any other regulatory document with the exception of the ones stipulated in Articles 9, 10, 11, 12 and 13 of this law.

第三章 行政處罰的實施機關

Chapter 3 Organs Imposing Administrative Penalties

第十五條   行政處罰由具有行政處罰權的行政機關在法定職權範圍內實施。

Article 15 Administrative penalties shall be imposed by administrative organs that have the power to impose administrative penalties within the scope of their statutory functions and powers.

第十六條   國務院或者經國務院授權的省、自治區、直轄市人民政府可以決定一個行政機關行使有關行政機關的行政處罰權,但限制人身自由的行政處罰權只能由公安機關行使。

Article 16 The State Council or the people's government of a province, autonomous region or municipality directly under the Central Government that is empowered by the State Council may decide to have an administrative organ exercise another administrative organs' power to impose administrative penalties. However, the power to impose administrative penalties involving restrictions on the freedom of the person shall only be exercised by public security organs.

第十七條   法律、法規授權的具有管理公共事務職能的組織可以在法定授權範圍內實施行政處罰。

Article 17 Organizations that are authorized by laws and regulations to deal with the administration of public affairs may impose administrative penalties within the scope of their powers as authorized by law.

第十八條   行政機關依照法律、法規或者規章的規定,可以在其法定權限內委托符合本法第十九條規定條件的組織實施行政處罰。行政機關不得委托其他組織或者個人實施行政處罰。

Article 18 In accordance with the provisions relevant laws, regulations or rules, an administrative organ may, within the scope of its powers as prescribed by law, entrust an organization that meets the conditions stipulated in Article 19 of this Law with imposing administrative penalty. An administrative organ may not entrust another organization or individual with imposing administrative penalty.

委托行政機關對受委托的組織實施行政處罰的行為應當負責監督,並對該行為的後果承擔法律責任。

The entrusting administrative organ shall be responsible for supervising the imposition of administrative penalty by the entrusted organization and shall bear legal responsibility for the consequences of the imposition.

受委托組織在委托範圍內,以委托行政機關名義實施行政處罰;不得再委托其他任何組織或者個人實施行政處罰。

The entrusted organization shall, within the scope of authorization, impose administrative penalties in the name of the entrusting administrative organ, and may not further entrust the task to any other organization or individual.

第十九條   受委托組織必須符合以下條件:

Article 19 The entrusted organization must meet the following conditions:

(一)依法成立的管理公共事務的事業組織;

1. institutions in charge of public affairs established in accordance with the law;

(二)具有熟悉有關法律、法規、規章和業務的工作人員;

(II) Manned with personnel who are familiar with relevant laws, regulations, rules and business operations;

(三)對違法行為需要進行技術檢查或者技術鑒定的,應當有條件組織進行相應的技術檢查或者技術鑒定。

(III) Where it is necessary to conduct technical examinations or technical appraisals for illegal acts, they shall have the ability to do so.

第四章 行政處罰的管轄和適用

Chapter 4 Jurisdiction and Application of Administrative Penalties

第二十條   行政處罰由違法行為發生地的縣級以上地方人民政府具有行政處罰權的行政機關管轄。法律、行政法規另有規定的除外。

Article 20 Administrative penalties shall come under the jurisdiction of an administrative organ having the power to administer penalties by a local people's government at or above the county level, in the place where the unlawful act was committed. Unless otherwise provided by laws and administrative regulations.

第二十一條   對管轄發生爭議的,報請共同的上一級行政機關指定管轄。

Article 21 If a dispute arises over jurisdiction between two or more administrative organs, the matter shall be reported to the higher-ranking supervising administrative organ who will designate the jurisdiction.

第二十二條   違法行為構成犯罪的,行政機關必須將案件移送司法機關,依法追究刑事責任。

Article 22 If an unlawful act constitutes a crime, the administrative organ must transfer the case to a judicial organ for investigation of criminal responsibility according to the law.

第二十三條   行政機關實施行政處罰時,應當責令當事人改正或者限期改正違法行為。

Article 23 When enforcing an administrative penalty, the administrative organ shall order the party to put right his illegal acts or to do so within a time limit.

第二十四條   對當事人的同一個違法行為,不得給予兩次以上罰款的行政處罰。

Article 24 Parties who commit the same unlawful act more than once, shall only receive a fine as an administrative penalty more than once.

第二十五條   不滿十四周歲的人有違法行為的,不予行政處罰,責令監護人加以管教;已滿十四周歲不滿十八周歲的人有違法行為的,從輕或者減輕行政處罰。

Article 25 If a person under the age of 14 commits an unlawful act, no administrative penalty shall be imposed on him, but his guardian shall be ordered to discipline and educate him; if a person who has reached the age of 14, but is not yet 18 years of age, commits an unlawful act, a lighter or mitigated administrative penalty shall be imposed on him.

第二十六條   精神病人在不能辨認或者不能控制自己行為時有違法行為的,不予行政處罰,但應當責令其監護人嚴加看管和治療。間歇性精神病人在精神正常時有違法行為的,應當給予行政處罰。

Article 26 If an individual with a mental illness commits an unlawful act at a time when he or she is unable to appreciate or cannot control his or her conduct, no administrative penalty shall be imposed on him or her, but his or her guardian shall be ordered to keep him or her under close surveillance and arrange for his or her medical treatment. Administrative penalty shall be imposed on a person whose mental illness is of an intermittent nature and who commits an illegal act when he is mentally normal.

第二十七條   當事人有下列情形之一的,應當依法從輕或者減輕行政處罰:

Article 27 Where a party concerned is under any of the following circumstances, it (he) shall be given a lighter or mitigated administrative punishment:

(一)主動消除或者減輕違法行為危害後果的;

1. He/it eliminates or reduces the negative effect of the illegal act on his/its own initiative;

(二)受他人脅迫有違法行為的;

2. Being coerced by others to commit the illegal act;

(三)配合行政機關查處違法行為有立功表現的;

(III) Performing meritorious services in cooperating with the administrative organ to investigate illegal acts;

(四)其他依法從輕或者減輕行政處罰的。

4. Other circumstances under which it shall be imposed upon a lighter or mitigated administrative penalty in accordance with the law.

違法行為輕微並及時糾正,沒有造成危害後果的,不予行政處罰。

Where a person commits a minor illegal act, promptly remedies his act and causes no harmful consequences, no administrative penalty shall be imposed on him.

第二十八條   違法行為構成犯罪,人民法院判處拘役或者有期徒刑時,行政機關已經給予當事人行政拘留的,應當依法折抵相應刑期。

Article 28 If an unlawful act constitutes a crime, for which a People's Court sentences him to criminal detention or fixed-term imprisonment, and if an administrative organ has already imposed administrative detention on the party, the length of the detention shall be the same as the term of imprisonment in accordance with law.

違法行為構成犯罪,人民法院判處罰金時,行政機關已經給予當事人罰款的,應當折抵相應罰金。

If an unlawful act constitutes a crime, for which a People's Court imposes a fine on the party, and if an administrative organ has already done so, the amount of the fine imposed by the latter shall be the same as that by the former.

第二十九條   違法行為在二年內未被發現的,不再給予行政處罰。法律另有規定的除外。

Article 29 Where an unlawful act is not discovered within two years of its commission, an administrative penalty will not be imposed. Unless otherwise required by law.

前款規定的期限,從違法行為發生之日起計算;違法行為有連續或者繼續狀態的,從行為終了之日起計算。

The time limit as prescribed in the preceding paragraph shall be calculated from the day when the illegal act occurs; if the illegal act is in a state of continuity or incessancy, the time limit shall be calculated from the day when the act terminates.

第五章 行政處罰的決定

Chapter 5 Decisions on Administrative Penalties

第三十條   公民、法人或者其他組織違反行政管理秩序的行為,依法應當給予行政處罰的,行政機關必須查明事實;違法事實不清的,不得給予行政處罰。

Article 30 Where citizens, legal persons or other organizations violate administrative orders, and are liable to administrative penalties according to law, administrative organs must determine the facts surrounding the violation; if the facts surrounding the violation are not clear, no administrative penalty shall be imposed.

第三十一條   行政機關在作出行政處罰決定之前,應當告知當事人作出行政處罰決定的事實、理由及依據,並告知當事人依法享有的權利。

Article 31 Before deciding to impose administrative penalties, administrative organs shall notify the parties of the facts, grounds and basis upon which the decision is decision is based and shall notify the parties of their rights enjoyed under the law.

第三十二條   當事人有權進行陳述和申辯。行政機關必須充分聽取當事人的意見,對當事人提出的事實、理由和證據,應當進行複核;當事人提出的事實、理由或者證據成立的,行政機關應當采納。

Article 32 A party shall have the right to state it's case and to defend itself. Administrative organs shall give due consideration to the opinions of the parties, and shall reexamine the facts, grounds and evidence put forward by the parties; if the facts, grounds and evidence put forward by the parties are established, the administrative organs shall accept them.

行政機關不得因當事人申辯而加重處罰。

Administrative organs shall not impose heavier penalties on the parties because they have tried to defend themselves.

第一節 簡易程序

Section 1 Summary Procedure

第三十三條   違法事實確鑿並有法定依據,對公民處以五十元以下、對法人或者其他組織處以一千元以下罰款或者警告的行政處罰的,可以當場作出行政處罰決定。當事人應當依照本法第四十六條、第四十七條、第四十八條的規定履行行政處罰決定。

Article 33 If the facts surrounding a violation of law have been proven and there is a legal basis for a finding of guilt, and if the citizen involved is not to be fined more than 50 RMB or the legal person, or another organization involved is not to be fined more than 1,000 RMB, or a disciplinary warning is to be given, such administrative penalties may be decided immediately. The party shall carry out the decision on administrative penalty in accordance with the provisions of Articles 46, 47 and 48 of this Law.

第三十四條   執法人員當場作出行政處罰決定的,應當向當事人出示執法身份證件,填寫預定格式、編有號碼的行政處罰決定書。行政處罰決定書應當當場交付當事人。

Article 34 If a law-enforcement officer decides to impose administrative penalties on the spot, he shall show the party his law enforcement identification papers and fill out an administrative penalty decision form. The form of decision for administrative penalty shall be given to the party on the spot.

前款規定的行政處罰決定書應當載明當事人的違法行為、行政處罰依據、罰款數額、時間、地點以及行政機關名稱,並由執法人員簽名或者蓋章。

In the form of decision for administrative penalty as stipulated in the preceding paragraph shall be clearly recorded the illegal act committed by the party, the basis for administrative penalty, the amount of fine, the time and place, and the title of the administrative organ. Such form shall also be signed or sealed by the law-enforcing officer.

執法人員當場作出的行政處罰決定,必須報所屬行政機關備案。

The decision on administrative punishment made by the law administering personnels on the spot must be reported to their administrative organs for record.

第三十五條   當事人對當場作出的行政處罰決定不服的,可以依法申請行政複議或者提起行政訴訟。

Article 35 If a party refuses to accept the decision regarding an administrative penalty made on the spot, he may apply for administrative reconsideration or bring an administrative lawsuit in accordance with the law.

第二節 一般程序

Section 2 General Procedures

第三十六條   除本法第三十三條規定的可以當場作出的行政處罰外,行政機關發現公民、法人或者其他組織有依法應當給予行政處罰的行為的,必須全面、客觀、公正地調查,收集有關證據;必要時,依照法律、法規的規定,可以進行檢查。

Article 36 With the exception of administrative penalties which may be imposed on the spot as provided by Article 33 of this Law, administrative organs, when discovering that citizens, legal persons or other organizations have committed acts for which administrative penalties should be imposed according to the law, shall conduct a comprehensive, objective and fair investigation and collect relevant evidence; when necessary, they may conduct inspections in accordance with laws and regulations.

第三十七條   行政機關在調查或者進行檢查時,執法人員不得少於兩人,並應當向當事人或者有關人員出示證件。當事人或者有關人員應當如實回答詢問,並協助調查或者檢查,不得阻撓。詢問或者檢查應當制作筆錄。

Article 37 When administrative organs conduct investigations or inspections, there shall not be less than two law- enforcement officers, who shall show their identification papers to the party or other persons concerned. The party and other persons concerned shall truthfully answer the questions and assist in the investigation or inspection; they may not obstruct such investigation or inspection. Written record shall be made for the inquiry or inspection.

行政機關在收集證據時,可以采取抽樣取證的方法;在證據可能滅失或者以後難以取得的情況下,經行政機關負責人批準,可以先行登記保存,並應當在七日內及時作出處理決定,在此期間,當事人或者有關人員不得銷毀或者轉移證據。

When collecting evidence, administrative organs may obtain evidence through sampling; under circumstances where there is a likelihood that the evidence may be destroyed or lost, or difficult to obtain later, administrative organs may, with the approval of their leading members, first register the evidence for preservation and shall make a timely decision on its disposition within seven days. During this period of time, the party and other persons concerned may not destroy or transfer the evidence.

執法人員與當事人有直接利害關系的,應當回避。

In case any law enforcer has any direct relationship of interests with the party concerned, he shall withdraw.

第三十八條   調查終結,行政機關負責人應當對調查結果進行審查,根據不同情況,分別作出如下決定:

Article 38 After an investigation has been concluded, leading officers of an administrative organ shall examine the results of the investigation and make one of the following decisions depending on the circumstances:

(一)確有應受行政處罰的違法行為的,根據情節輕重及具體情況,作出行政處罰決定;

1. Where there is an illegal conduct for which an administrative penalty shall be imposed, an administrative penalty decision shall be made in light of the seriousness of the circumstances and the actual situation;

(二)違法行為輕微,依法可以不予行政處罰的,不予行政處罰;

(II) Where the illegal act is minor and the administrative penalty may be exempted according to law, the administrative penalty may be exempted;

(三)違法事實不能成立的,不得給予行政處罰;

(III) Where the facts of illegality cannot be established, no administrative penalty may be imposed;

(四)違法行為已構成犯罪的,移送司法機關。

(IV) If the violation has constituted any crime, it shall be delivered to the judicial organ for handling.

對情節複雜或者重大違法行為給予較重的行政處罰,行政機關的負責人應當集體討論決定。

Before imposing a heavier administrative penalty for an unlawful act which is of a complicated or grave nature, the leading members of an administrative organ shall make a collective decision after discussion.

在行政機關負責人作出決定之前,應當由從事行政處罰決定審核的人員進行審核。行政機關中初次從事行政處罰決定審核的人員,應當通過國家統一法律職業資格考試取得法律職業資格。

The decision shall be reviewed by persons who engage in reviewing decisions of administrative penalties before it is made by the person in charge of the administrative organ. Persons who engage in reviewing decisions of administrative penalties for the first time in administrative organs shall pass the national unified legal professional qualification exam and obtain the legal professional qualification.

第三十九條   行政機關依照本法第三十八條的規定給予行政處罰,應當制作行政處罰決定書。行政處罰決定書應當載明下列事項:

Article 39 To impose administrative penalties according to the provisions of Article 38 of this Law, an administrative organ shall fill out administrative penalty decision form. The statement of decision on administrative punishment shall carry the following items:

(一)當事人的姓名或者名稱、地址;

1. The name or title and address of the party involved;

(二)違反法律、法規或者規章的事實和證據;

(II) The facts in violation of any law, regulation or rule and the relevant evidence;

(三)行政處罰的種類和依據;

(III) The type of and basis for the administrative penalty;

(四)行政處罰的履行方式和期限;

(IV) The manner of and time limit for enforcement of the administrative penalty;

(五)不服行政處罰決定,申請行政複議或者提起行政訴訟的途徑和期限;

(V) The procedure for and time limit applicable to any application for an administrative review of or any administrative lawsuit that may be filed in relation to the relevant administrative penalty; and

(六)作出行政處罰決定的行政機關名稱和作出決定的日期。

(VI) Name of the administrative organ that makes the administrative penalty decision and date of making the decision.

行政處罰決定書必須蓋有作出行政處罰決定的行政機關的印章。

The seal of the administrative organ that makes the decision on administrative penalty must be affixed to the written decision on administrative penalty.

第四十條   行政處罰決定書應當在宣告後當場交付當事人;當事人不在場的,行政機關應當在七日內依照民事訴訟法的有關規定,將行政處罰決定書送達當事人。

Article 40 The form of decision for administrative penalty shall be given to the party on the spot after announcement of the decision; if the party is not present, the administrative organ shall, within seven days, serve the form of decision for administrative penalty on the party in accordance with the relevant provisions of the Civil Procedure Law.

第四十一條   行政機關及其執法人員在作出行政處罰決定之前,不依照本法第三十一條、第三十二條的規定向當事人告知給予行政處罰的事實、理由和依據,或者拒絕聽取當事人的陳述、申辯,行政處罰決定不能成立;當事人放棄陳述或者申辯權利的除外。

Article 41 If, before making a decision regarding the imposition of an administrative penalty, an administrative organ or its law-enforcement officer, fails to notify, as stipulated in Articles 31 and 32 of this Law, the party of the facts surrounding the violation, the claims and the basis upon which the administrative penalty is imposed, or refuses to heed the party's statement and the party refuses to defend itself, the decision regarding the imposition of an administrative penalty shall be invalid, unless the party waives the right to make a statement or to defend itself.

第三節 聽證程序

Section 3 Procedures for Hearings

第四十二條   行政機關作出責令停產停業、吊銷許可證或者執照、較大數額罰款等行政處罰決定之前,應當告知當事人有要求舉行聽證的權利;當事人要求聽證的,行政機關應當組織聽證。當事人不承擔行政機關組織聽證的費用。聽證依照以下程序組織:

Article 42 An administrative organ, before making a decision regarding the imposition of an administrative penalty that involves the order of the suspension of production or of business, the rescission of a business permit or a license or the imposition of a relatively heavy fine, shall notify the party that he has the right to request a hearing; if the party requests a hearing, the administrative organ shall arrange for the hearing. The party shall not bear the expenses for the hearing arranged by the administrative organ. The hearing shall be organized in accordance with the following procedures:

(一)當事人要求聽證的,應當在行政機關告知後三日內提出;

1. The party shall, within 3 days after being informed by the administrative organ, request a hearing;

(二)行政機關應當在聽證的七日前,通知當事人舉行聽證的時間、地點;

(II) The administrative organ shall notify the party of the time and place of the hearing seven days before it;

(三)除涉及國家秘密、商業秘密或者個人隱私外,聽證公開舉行;

(III) The hearing shall be held in public unless it involves state secrets, business secrets or personal privacy;

(四)聽證由行政機關指定的非本案調查人員主持;當事人認為主持人與本案有直接利害關系的,有權申請回避;

(IV) The hearing shall be presided over by a person who is not an investigator of the case designated by the administrative organ; if the party believes that the person has a direct interest in the case, he shall have the right to apply for the person's withdrawal;

(五)當事人可以親自參加聽證,也可以委托一至二人代理;

(V) The party may attend the hearing in person or entrust one or two agents to attend the hearing;

(六)舉行聽證時,調查人員提出當事人違法的事實、證據和行政處罰建議;當事人進行申辯和質證;

(VI) When a hearing is held, the investigators shall put forward the facts and evidence proving that the party has violated the law, and the suggestions on administrative punishment; the party shall make statements and cross-examinations; and

(七)聽證應當制作筆錄;筆錄應當交當事人審核無誤後簽字或者蓋章。

(VII) Written record shall be made for the hearing, which shall be signed or sealed by the parties after being examined to have no mistake.

當事人對限制人身自由的行政處罰有異議的,依照治安管理處罰法有關規定執行。

If the party has an objection to an administrative penalty that involves the restriction of the freedom of the person, the relevant provisions of the Law on Administrative Penalties for Public Security shall apply.

第四十三條   聽證結束後,行政機關依照本法第三十八條的規定,作出決定。

Article 43 When a hearing is concluded, the administrative organ shall make a decision in accordance with the provisions of Article 38 of this Law.

第六章 行政處罰的執行

Chapter 6 Enforcement of Administrative Penalties

第四十四條   行政處罰決定依法作出後,當事人應當在行政處罰決定的期限內,予以履行。

Article 44 After a decision of administrative punishment is made, the party concerned shall execute it within the time limit as specified therein.

第四十五條   當事人對行政處罰決定不服申請行政複議或者提起行政訴訟的,行政處罰不停止執行,法律另有規定的除外。

Article 45 If a party refuses to accept the decision regarding the imposition of an administrative penalty and applies for administrative reconsideration or brings an administrative lawsuit, enforcement of the administrative penalty shall not be suspended, except as otherwise prescribed by law.

第四十六條   作出罰款決定的行政機關應當與收繳罰款的機構分離。

Article 46 The administrative organ that makes the decision regarding the imposition of a fine shall not be responsible for collecting the fine.

除依照本法第四十七條、第四十八條的規定當場收繳的罰款外,作出行政處罰決定的行政機關及其執法人員不得自行收繳罰款。

Except for circumstances under which fines are collected on the spot according to the provisions of Articles 47 and 48 of this Law, no administrative organs that make a decision on administrative penalty or their law-enforcing officers shall collect fines themselves.

當事人應當自收到行政處罰決定書之日起十五日內,到指定的銀行繳納罰款。銀行應當收受罰款,並將罰款直接上繳國庫。

The party shall, within 15 days from the date he receives the decision on administrative penalty, pay the fine at the designated bank. The banks shall accept the fines and turn them over directly to the State Treasury.

第四十七條   依照本法第三十三條的規定當場作出行政處罰決定,有下列情形之一的,執法人員可以當場收繳罰款:

Article 47 If a decision regarding the imposition of an administrative penalty is made on the spot in accordance with the provisions of Article 33 of this Law, law enforcement officers may collect the fine immediately under one of the following circumstances:

(一)依法給予二十元以下的罰款的;

1. Where a fine of less than CNY20 is imposed; or

(二)不當場收繳事後難以執行的。

(II) It is difficult to execute afterwards if the fine is not collected on the spot.

第四十八條   在邊遠、水上、交通不便地區,行政機關及其執法人員依照本法第三十三條、第三十八條的規定作出罰款決定後,當事人向指定的銀行繳納罰款確有困難,經當事人提出,行政機關及其執法人員可以當場收繳罰款。

Article 48 If, after a decision regarding the imposition of a fine is made by an administrative organ or its law enforcement officers, in accordance with the provisions of Article 33 or Article 38 of this Law, it is difficult for a party located in a remote area, or on water or does not have easy access to a designated bank where it can pay the fine,, the administrative organ or its law enforcement officers may, upon a party's request, collect the fine on the spot.

第四十九條   行政機關及其執法人員當場收繳罰款的,必須向當事人出具省、自治區、直轄市財政部門統一制發的罰款收據;不出具財政部門統一制發的罰款收據的,當事人有權拒絕繳納罰款。

Article 49 Where fines are collected on the spot by an administrative organ or its law enforcement officers, the parties shall be given receipts for the fines as are uniformly made and issued by finance departments of provinces, autonomous regions or municipalities directly under the Central Government; if such receipts are not given, the parties shall have the right to refuse payment of the fine.

第五十條   執法人員當場收繳的罰款,應當自收繳罰款之日起二日內,交至行政機關;在水上當場收繳的罰款,應當自抵岸之日起二日內交至行政機關;行政機關應當在二日內將罰款繳付指定的銀行。

Article 50 Fines collected by law enforcement officers on the spot shall be turned over to administrative organs within two days from the date of collection; fines collected on the spot at an marine location shall be turned over to administrative organs within two days from the date of returning to land; the administrative organs shall, within two days, deliver the fines to a designated bank.

第五十一條   當事人逾期不履行行政處罰決定的,作出行政處罰決定的行政機關可以采取下列措施:

Article 51 Where a party does not implement a decision on administrative penalty within the time limit, the administrative organ making the said decision may take the following measures:

(一)到期不繳納罰款的,每日按罰款數額的百分之三加處罰款;

1. If he does not pay the mature fine, he shall be imposed upon an additional interest of 3% per day;

(二)根據法律規定,將查封、扣押的財物拍賣或者將凍結的存款劃撥抵繳罰款;

2. in accordance with law, to sell by auction the sealed up or seized property or things of value or to transfer frozen deposits to pay fines; and

(三)申請人民法院強制執行。

(III) Apply to the people's court for enforcement.

第五十二條   當事人確有經濟困難,需要延期或者分期繳納罰款的,經當事人申請和行政機關批準,可以暫緩或者分期繳納。

Article 52 If the parties have genuine financial difficulties and need to postpone payment of the fine or pay them in installments, payment may be temporarily suspended or made in installments after the parties have applied to, and obtained, approval from the administrative organs.

第五十三條   除依法應當予以銷毀的物品外,依法沒收的非法財物必須按照國家規定公開拍賣或者按照國家有關規定處理。

Article 53 With the exception of confiscated articles or goods that should be destroyed in accordance with law, the unlawful property or objects of value that have been confiscated shall be sold by public auction in accordance with the regulations of the State, or shall be disposed of in accordance with the relevant State regulations.

罰款、沒收違法所得或者沒收非法財物拍賣的款項,必須全部上繳國庫,任何行政機關或者個人不得以任何形式截留、私分或者變相私分;財政部門不得以任何形式向作出行政處罰決定的行政機關返還罰款、沒收的違法所得或者返還沒收非法財物的拍賣款項。

Fines, confiscated illegal earnings or proceeds of the illegal property by auction must be handed over in its entirety to the state treasury, and shall not be withheld or shared privately and secretly in any manner by any administrative organs or individuals. Financial departments shall not return in any forms to administrative organs making decisions on administrative punishments, the fines, confiscated illegal earnings or proceeds by auction of the confiscated illegal property.

第五十四條   行政機關應當建立健全對行政處罰的監督制度。縣級以上人民政府應當加強對行政處罰的監督檢查。

Article 54 Administrative organs shall establish a thorough supervisory system for the imposition and enforcement of administrative penalties. People's Governments of county level and above shall strengthen supervision and inspection of administrative punishment.

公民、法人或者其他組織對行政機關作出的行政處罰,有權申訴或者檢舉;行政機關應當認真審查,發現行政處罰有錯誤的,應當主動改正。

A citizen, a legal person or any other organization shall have the right to appeal an administrative penalty imposed by an administrative organ. The administrative organ shall carefully examine the appeal, and where it finds that the administrative penalty is wrong, it shall take the initiative to correct it.

第七章 法律責任

Chapter 7 Legal Liabilities

第五十五條   行政機關實施行政處罰,有下列情形之一的,由上級行政機關或者有關部門責令改正,可以對直接負責的主管人員和其他直接責任人員依法給予行政處分:

Article 55 If an administrative organ imposes an administrative penalty in any of the following manners, it shall be ordered by the administrative organ at the higher level or a relevant department to make correction, and administrative sanctions may, in accordance with law, be imposed upon the persons who are directly in charge and other persons who are directly responsible for the offense:

(一)沒有法定的行政處罰依據的;

1. Having no legal basis for the administrative punishment;

(二)擅自改變行政處罰種類、幅度的;

2. Unlawfully changing the type or severity of an administrative punishment;

(三)違反法定的行政處罰程序的;

(III) Violating the statutory administrative penalty procedures;

(四)違反本法第十八條關於委托處罰的規定的。

(IV) Violating the provisions of Article 18 of the Law on entrusting punishments.

第五十六條   行政機關對當事人進行處罰不使用罰款、沒收財物單據或者使用非法定部門制發的罰款、沒收財物單據的,當事人有權拒絕處罰,並有權予以檢舉。上級行政機關或者有關部門對使用的非法單據予以收繳銷毀,對直接負責的主管人員和其他直接責任人員依法給予行政處分。

Article 56 If administrative organs, when imposing penalties on the parties, do not use the appropriate documents necessary to be completed when imposing fines and confiscating property or objects of value, or complete documents necessary to be completed when imposing fines and confiscating property or objects of value, that are prepared and issued by non-statutory departments, the parties have the right to refuse to accept the penalties, and the right to appeal the decision. The administrative organs at higher levels or the relevant departments shall confiscate and destroy the illegal documents in use and shall, in accordance with law, impose administrative sanctions upon the persons who are directly in charge and other persons who are directly responsible for the offense.

第五十七條   行政機關違反本法第四十六條的規定自行收繳罰款的,財政部門違反本法第五十三條的規定向行政機關返還罰款或者拍賣款項的,由上級行政機關或者有關部門責令改正,對直接負責的主管人員和其他直接責任人員依法給予行政處分。

Article 57 If administrative organs, in violation of Article 46 of this Law, collect fines themselves, if finance departments, in violation of Article 53 of this Law, return to administrative organs fines collected or money obtained from the sale by auction of confiscated unlawful property or objects of value, the administrative organs at higher levels or relevant departments shall order them to remedy their actions and shall, in accordance with the law, impose administrative sanctions upon the persons who are directly in charge and any other person who is directly responsible for the offense.

第五十八條   行政機關將罰款、沒收的違法所得或者財物截留、私分或者變相私分的,由財政部門或者有關部門予以追繳,對直接負責的主管人員和其他直接責任人員依法給予行政處分;情節嚴重構成犯罪的,依法追究刑事責任。

Article 58 The fines, confiscated unlawful gains, property or objects of value that are withheld, shared privately or embezzled by administrative organs shall be recovered by finance departments or relevant departments, and the persons who are directly in charge and any other persons who are directly responsible for the offense shall be given administrative sanctions according to the law; if the offense is serious enough to constitute a crime, criminal liability shall be investigated in accordance with the law.

執法人員利用職務上的便利,索取或者收受他人財物、收繳罰款據為己有,構成犯罪的,依法追究刑事責任;情節輕微不構成犯罪的,依法給予行政處分。

If law-enforcing officers, taking advantage of their functions, ask for or accept other person's property or things of value or take into their own possession fines they have collected and, if the offense constitutes a crime, they shall be investigated for criminal liability in accordance with law; if the offense is of a minor nature and does not constitute a crime, administrative sanctions shall be imposed upon them in accordance with law.

第五十九條   行政機關使用或者損毀扣押的財物,對當事人造成損失的,應當依法予以賠償,對直接負責的主管人員和其他直接責任人員依法給予行政處分。

Article 59 If administrative organs use or destroy the property or objects of value they have seized, and thus cause losses to the parties, they shall provide compensation to the parties, and administrative sanctions shall be imposed upon the persons who are directly in charge and any other persons who are directly responsible for the offense.

第六十條   行政機關違法實行檢查措施或者執行措施,給公民人身或者財產造成損害、給法人或者其他組織造成損失的,應當依法予以賠償,對直接負責的主管人員和其他直接責任人員依法給予行政處分;情節嚴重構成犯罪的,依法追究刑事責任。

Article 60 If administrative organs violate the law when conducting inspections or executing an administrative order, and consequently inflict damage on the person or property of citizens, or cause losses to legal persons or other organizations, they shall be responsible for compensating the parties for their losses, and the persons who are directly in charge and any other persons who are directly responsible for the offense shall be subject to administrative sanctions in accordance with the law; if the offence is serious enough to constitute a crime, criminal liability shall be investigated.

第六十一條   行政機關為牟取本單位私利,對應當依法移交司法機關追究刑事責任的不移交,以行政處罰代替刑罰,由上級行政機關或者有關部門責令糾正;拒不糾正的,對直接負責的主管人員給予行政處分;徇私舞弊、包庇縱容違法行為的,依照刑法有關規定追究刑事責任。

Article 61 If administrative organs, for the purpose of seeking departmental gain, do not transfer cases to judicial organs for investigation of criminal liability as they should do in accordance with law but impose administrative penalty in place of criminal penalty, the administrative organs at higher levels or relevant departments shall order them to make correction; if they refuse to do so, administrative sanctions shall be imposed upon the persons who are directly in charge; persons who practice irregularities for personal gain, cover up or connive at violations of law shall be investigated for criminal liability according to relevant provisions of the Criminal Law.

第六十二條   執法人員玩忽職守,對應當予以制止和處罰的違法行為不予制止、處罰,致使公民、法人或者其他組織的合法權益、公共利益和社會秩序遭受損害的,對直接負責的主管人員和其他直接責任人員依法給予行政處分;情節嚴重構成犯罪的,依法追究刑事責任。

Article 62 If unlawful acts that should be investigated and punished are not investigated and punished due to a dereliction of duty by a law enforcement officer, thus damaging the lawful rights and interests of citizens, legal persons and other organizations, as well as the public interest and the public order, the persons who are directly in charge and any other persons who are directly responsible for the offense shall be subject to administrative sanctions; if the violation is serious enough to constitute a crime, criminal liability shall be investigated.

第八章

Chapter 8 Supplementary Provisions

第六十三條   本法第四十六條罰款決定與罰款收繳分離的規定,由國務院制定具體實施辦法。

Article 63 Specific measures for implementing the provisions of Article 46 of this Law concerning separation of the organs that make decisions regarding whether to impose fines, from the organs that collect fines, shall be formulated by the State Council.

第六十四條   本法自1996101日起施行。

Article 64 This Law shall go into effect as of October 1, 1996.

本法公布前制定的法規和規章關於行政處罰的規定與本法不符合的,應當自本法公布之日起,依照本法規定予以修訂,在19971231日前修訂完畢。

Provisions regarding administrative penalty in the regulations and rules, enacted before the promulgation of this Law, that do not comply with the provisions of this Law shall be amended in accordance with the provisions of this Law from the date of promulgation of this Law, and such amendments shall be completed before December 31, 1997.
