Animal Husbandry Law of the People’s Republic of China (Revision 2015)

第一章 總則

Chapter 1 General Provisions

第一條   為了規範畜牧業生產經營行為，保障畜禽產品質量安全，保護和合理利用畜禽遺傳資源，維護畜牧業生產經營者的合法權益，促進畜牧業持續健康發展，制定本法。

Article 1 This Law is enacted for the purpose of regulating the production and business operations of stockbreeding, ensuring the quality and safety of livestock and poultry products, protecting and reasonably utilizing the genetic resources of livestock and poultry, protecting the legitimate rights and interests of the stockbreeding producers and business operators, and promoting the sustainable and sound development of stockbreeding.

第二條   在中華人民共和國境內從事畜禽的遺傳資源保護利用、繁育、飼養、經營、運輸等活動，適用本法。

Article 2 This Law shall apply to the protection and utilization of the genetic resources, breeding, raising, business operations and transport of livestock and poultry within the People's Republic of China.

本法所稱畜禽，是指列入依照本法第十一條規定公布的畜禽遺傳資源目錄的畜禽。

The "livestock and poultry" as mentioned in this Law refers to those included in the list of genetic resources of livestock and poultry that shall be announced in accordance with Article 11 of this Law.

蜂、蠶的資源保護利用和生產經營，適用本法有關規定。

The relevant provisions of this Law shall be applicable to protection and utilization of, as well as production and operation in, bee and silkworm resources.

第三條   國家支持畜牧業發展，發揮畜牧業在發展農業、農村經濟和增加農民收入中的作用。縣級以上人民政府應當采取措施，加強畜牧業基礎設施建設，鼓勵和扶持發展規模化養殖，推進畜牧產業化經營，提高畜牧業綜合生產能力，發展優質、高效、生態、安全的畜牧業。

Article 3 The State supports the development of animal husbandry and gives play to its role in the development of agriculture and the rural economy as well as in the increase of the farmers' income. The people's governments at or above the county level shall take measures to strengthen the construction of the basic facilities for stockbreeding, encourage and support the development of breeding on a large- scale basis, push forward the industrialized operations of stockbreeding, promote the comprehensive production capacity and develop stockbreeding into a high-quality, highly efficient, ecological, and safe industry.

國家幫助和扶持少數民族地區、貧困地區畜牧業的發展，保護和合理利用草原，改善畜牧業生產條件。

The state shall help and support the development of the stockbreeding industry in areas of ethnic minorities and poverty-stricken areas, protect and reasonably utilize the pastures and improve the production conditions for stockbreeding.

第四條   國家采取措施，培養畜牧獸醫專業人才，發展畜牧獸醫科學技術研究和推廣事業，開展畜牧獸醫科學技術知識的教育宣傳工作和畜牧獸醫信息服務，推進畜牧業科技進步。

Article 4 The state shall take measures to foster professional stockbreeding and veterinary talents, develop the research and popularization of the science and technology of stockbreeding and veterinary, carry out the education and publicity of scientific and technological knowledge of stockbreeding and veterinary as well as stockbreeding and veterinary information services, and push forward the scientific and technological progress of the stockbreeding industry.

第五條   畜牧業生產經營者可以依法自願成立行業協會，為成員提供信息、技術、營銷、培訓等服務，加強行業自律，維護成員和行業利益。

Article 5 The producers and business operators of stockbreeding may establish industrial associations on their own initiatives so as to provide the members with information, technology, marketing and training services, to intensify the industrial self-discipline and to protect the interests of the members and the whole sector.

第六條   畜牧業生產經營者應當依法履行動物防疫和環境保護義務，接受有關主管部門依法實施的監督檢查。

Article 6 The producers and business operators of stockbreeding shall perform the obligations to prevent animal diseases and to protect the environment, and shall accept the supervision and inspection conducted by the relevant competent organs in accordance with the law.

第七條   國務院畜牧獸醫行政主管部門負責全國畜牧業的監督管理工作。縣級以上地方人民政府畜牧獸醫行政主管部門負責本行政區域內的畜牧業監督管理工作。

Article 7 The stockbreeding and veterinary administrative department of the State Council shall be responsible for the stockbreeding supervision and administration throughout the country. The stockbreeding and veterinary administrative departments of the people's governments at or above the county level shall be responsible for the stockbreeding supervision and administration within their respective administrative area.

縣級以上人民政府有關主管部門在各自的職責範圍內，負責有關促進畜牧業發展的工作。

The relevant competent departments of the people's governments at or above the county level shall, within the scope of their respective duties, be responsible for promoting the development of stockbreeding.

第八條   國務院畜牧獸醫行政主管部門應當指導畜牧業生產經營者改善畜禽繁育、飼養、運輸的條件和環境。

Article 8 The stockbreeding and veterinary administrative department of the State Council shall offer guidance to the producers and business operators of stockbreeding to improve the conditions and environment for the breeding, rearing, and transport of livestock and poultry.

第二章 畜禽遺傳資源保護

Chapter 2 Protection of Genetic Resources of Livestock and Poultry

第九條   國家建立畜禽遺傳資源保護制度。各級人民政府應當采取措施，加強畜禽遺傳資源保護，畜禽遺傳資源保護經費列入財政預算。

Article 9 The State establishes the system for protection of the genetic resources of livestock and poultry. The people's governments at all levels shall take measures to intensify the protection of the genetic resources of livestock and poultry, and shall incorporate the relevant expenses in the fiscal budget.

畜禽遺傳資源保護以國家為主，鼓勵和支持有關單位、個人依法發展畜禽遺傳資源保護事業。

The state shall play the major role in the protection of the genetic resources of livestock and poultry while the relevant entities and individuals shall be encouraged and supported to develop undertakings for the protection of the genetic resources of livestock and poultry by law.

第十條   國務院畜牧獸醫行政主管部門設立由專業人員組成的國家畜禽遺傳資源委員會，負責畜禽遺傳資源的鑒定、評估和畜禽新品種、配套系的審定，承擔畜禽遺傳資源保護和利用規劃論證及有關畜禽遺傳資源保護的諮詢工作。

Article 10 The stockbreeding and veterinary administrative department of the State Council shall establish the National Commission for the Livestock and Poultry Genetic Resources, which shall consist of professionals, and shall be responsible for the appraisal and evaluation of Livestock and Poultry Genetic Resources as well as the examination and approval of new species and genetic improvement system, and shall carry out the demonstration of the plan on the protection and utilization of Livestock and Poultry Genetic Resources, as well as the consultation regarding the protection of livestock and poultry genetic resources.

第十一條   國務院畜牧獸醫行政主管部門負責組織畜禽遺傳資源的調查工作，發布國家畜禽遺傳資源狀況報告，公布經國務院批準的畜禽遺傳資源目錄。

Article 11 The stockbreeding and veterinary administrative department of the State Council shall be responsible for organizing the investigation of livestock and poultry genetic resources, releasing national reports about the status of livestock and poultry genetic resources and publishing the list of livestock and poultry genetic resources approved by the State Council.

第十二條   國務院畜牧獸醫行政主管部門根據畜禽遺傳資源分布狀況，制定全國畜禽遺傳資源保護和利用規劃，制定並公布國家級畜禽遺傳資源保護名錄，對原產我國的珍貴、稀有、瀕危的畜禽遺傳資源實行重點保護。

Article 12 The stockbreeding and veterinary administrative department of the State Council shall, according to the distribution of the livestock and poultry genetic resources, formulate the national plan on the protection and utilization of livestock and poultry genetic resources as well as the national protection list of livestock and poultry genetic resources, Key protection shall be given to the genetic resources of precious, rare and endangered livestock and poultry originated from China.

省級人民政府畜牧獸醫行政主管部門根據全國畜禽遺傳資源保護和利用規劃及本行政區域內畜禽遺傳資源狀況，制定和公布省級畜禽遺傳資源保護名錄，並報國務院畜牧獸醫行政主管部門備案。

The stockbreeding and veterinary administrative departments of the provincial people's governments shall, according to the plan on the protection and utilization of livestock and poultry genetic resources as well as the status of the livestock and poultry genetic resources within their respective administrative area, set forth and publish the provincial protection list of the livestock and poultry genetic resources, and submit it to the stockbreeding and veterinary administrative department of the State Council for archival purposes.

第十三條   國務院畜牧獸醫行政主管部門根據全國畜禽遺傳資源保護和利用規劃及國家級畜禽遺傳資源保護名錄，省級人民政府畜牧獸醫行政主管部門根據省級畜禽遺傳資源保護名錄，分別建立或者確定畜禽遺傳資源保種場、保護區和基因庫，承擔畜禽遺傳資源保護任務。

Article 13 The stockbreeding and veterinary administrative department of the State Council shall, according to the national plan on the protection and utilization of livestock and poultry genetic resources as well as the national protection list of livestock and poultry genetic resources, the provincial people's governments shall, according to the provincial protection list of livestock and poultry genetic resources, respectively establish or determine breeding protection places, areas and gene databases of livestock and poultry genetic resources, and shall undertake the task of protection of the livestock and poultry genetic resources.

享受中央和省級財政資金支持的畜禽遺傳資源保種場、保護區和基因庫，未經國務院畜牧獸醫行政主管部門或者省級人民政府畜牧獸醫行政主管部門批準，不得擅自處理受保護的畜禽遺傳資源。

Without approval of the stockbreeding and veterinary administrative department of the State Council or the stockbreeding or veterinary administrative department of the provincial people's government, no breeding protection place, protection area or gene database of livestock and poultry genetic resources funded by the Central Finance and provincial finance may dispose of any livestock or poultry genetic resource under protection.

畜禽遺傳資源基因庫應當按照國務院畜牧獸醫行政主管部門或者省級人民政府畜牧獸醫行政主管部門的規定，定期采集和更新畜禽遺傳材料。有關單位、個人應當配合畜禽遺傳資源基因庫采集畜禽遺傳材料，並有權獲得適當的經濟補償。

A gene database of livestock and poultry genetic resources shall, according to the provisions of the stockbreeding and veterinary administrative department of the State Council or the stockbreeding or veterinary administrative department of the provincial people 's government, regularly gather and update the livestock and poultry genetic materials. The relevant entities and individuals shall cooperate with the gene databases of livestock and poultry genetic resources in collecting livestock and poultry genetic materials and may be entitled to obtain reasonable economic compensation.

畜禽遺傳資源保種場、保護區和基因庫的管理辦法由國務院畜牧獸醫行政主管部門制定。

The administrative measures for the breeding protection places, protection areas and gene databases shall be formulated by the stockbreeding and veterinary administrative department of the State Council.

第十四條   新發現的畜禽遺傳資源在國家畜禽遺傳資源委員會鑒定前，省級人民政府畜牧獸醫行政主管部門應當制定保護方案，采取臨時保護措施，並報國務院畜牧獸醫行政主管部門備案。

Article 14 Before a newly found livestock or poultry genetic resource is appraised by the National Commission for Livestock and Poultry Genetic Resources, the stockbreeding and veterinary administrative department of the provincial people's government shall formulate a protection plan, take temporary protection measures and report it to the stockbreeding and veterinary administrative department of the State Council for archival purposes.

第十五條   從境外引進畜禽遺傳資源的，應當向省級人民政府畜牧獸醫行政主管部門提出申請；受理申請的畜牧獸醫行政主管部門經審核，報國務院畜牧獸醫行政主管部門經評估論證後批準。經批準的，依照《中華人民共和國進出境動植物檢疫法》的規定辦理相關手續並實施檢疫。

Article 15 Where a livestock or poultry genetic resource is to be imported from abroad, an application shall be filed with the stockbreeding and veterinary administrative department of the provincial people's government. The stockbreeding and veterinary administrative department that accepts this application shall, upon examination, report it to the stockbreeding and veterinary administrative department of the State Council for evaluation, argumentation and approval. Upon approval, the relevant formalities shall be completed and quarantine inspection shall be implemented pursuant to the provisions of the Law of the People's Republic of China on Quarantine of Importing and Exporting Animals and Plants.

從境外引進的畜禽遺傳資源被發現對境內畜禽遺傳資源、生態環境有危害或者可能產生危害的，國務院畜牧獸醫行政主管部門應當商有關主管部門，采取相應的安全控制措施。

Where it is found that a livestock or poultry genetic resource imported from abroad is harmful to or is likely to be harmful to the livestock or poultry genetic resource or ecological environment at home, the stockbreeding and veterinary administrative department of the State Council shall, in consultation with the relevant administrative departments, take corresponding safety control measures.

第十六條   向境外輸出或者在境內與境外機構、個人合作研究利用列入保護名錄的畜禽遺傳資源的，應當向省級人民政府畜牧獸醫行政主管部門提出申請，同時提出國家共享惠益的方案；受理申請的畜牧獸醫行政主管部門經審核，報國務院畜牧獸醫行政主管部門批準。

Article 16 Where any livestock or poultry genetic resource included in the protection list is to be exported or is to be researched and utilized at home in cooperation with any foreign institution or individual, the applicant shall file an application with the stockbreeding and veterinary administrative department of the provincial people's government and shall simultaneously put forward a plan on sharing the benefits with the state. The stockbreeding and veterinary administrative department that accepts the application shall, upon examination, report them to the stockbreeding and veterinary administrative department of the State Council for approval.

向境外輸出畜禽遺傳資源的，還應當依照《中華人民共和國進出境動植物檢疫法》的規定辦理相關手續並實施檢疫。

Where any livestock or poultry genetic resource is to be exported from China, the relevant formalities shall be completed and the livestock or poultry genetic resource shall be quarantined in accordance with the Law of the People's Republic of China on the Quarantine of Importing and Exporting Animals and Plants.

新發現的畜禽遺傳資源在國家畜禽遺傳資源委員會鑒定前，不得向境外輸出，不得與境外機構、個人合作研究利用。

Before a newly discovered livestock or poultry genetic resource is appraised by the National Commission for Livestock and Poultry Genetic Resources, it shall not be exported abroad, nor shall it be researched and utilized in cooperation with any foreign institution or individual.

第十七條   畜禽遺傳資源的進出境和對外合作研究利用的審批辦法由國務院規定。

Article 17 The measures for the examination and approval of the entry and exit as well as the foreign-related cooperative research and utilization of livestock and poultry genetic resources shall be formulated by the State Council.

第三章 種畜禽品種選育與生產經營

Chapter III Variety Breeding of the Breeding Livestock and Poultry

第十八條   國家扶持畜禽品種的選育和優良品種的推廣使用，支持企業、院校、科研機構和技術推廣單位開展聯合育種，建立畜禽良種繁育體系。

Article 18 The State gives support to the selective breeding of different strains of livestock and poultry and to the wide use of improved strains, supports enterprises, colleges and universities, scientific and research institutions and technological popularization units in their efforts to carry out joint breeding and set up a system for the breeding of improved strains of livestock and poultry.

第十九條   培育的畜禽新品種、配套系和新發現的畜禽遺傳資源在推廣前，應當通過國家畜禽遺傳資源委員會審定或者鑒定，並由國務院畜牧獸醫行政主管部門公告。畜禽新品種、配套系的審定辦法和畜禽遺傳資源的鑒定辦法，由國務院畜牧獸醫行政主管部門制定。審定或者鑒定所需的試驗、檢測等費用由申請者承擔，收費辦法由國務院財政、價格部門會同國務院畜牧獸醫行政主管部門制定。

Article 19 Before any newly bred species of livestock or poultry, genetic improvement system, or newly found livestock or poultry genetic resource is popularized, it shall be subject to examination and approval or appraisal conducted by the National Commission for Livestock and Poultry Genetic Resources, and it shall be announced by the stockbreeding and veterinary administrative department of the State Council. The measures for the examination and approval of newly bred species, the genetic improvement system of livestock and poultry, and the measures for the appraisal of livestock and poultry genetic resources shall be formulated by the stockbreeding and veterinary administrative department of the State Council. The fees for the experiment or testing necessary for examination and approval or appraisal shall be paid by the applicant. The relevant fee charging measures shall be formulated by the public finance and price departments of the State Council jointly with the stockbreeding and veterinary administrative department of the State Council.

培育新的畜禽品種、配套系進行中間試驗，應當經試驗所在地省級人民政府畜牧獸醫行政主管部門批準。

The intermediate experiments for breeding any new species or genetic improvement system of livestock or poultry shall be subject to the approval of the stockbreeding and veterinary administrative department of the provincial people's government where the experiment is carried out.

畜禽新品種、配套系培育者的合法權益受法律保護。

The legitimate rights and interests of the breeders of new strains of livestock and poultry and their synthetic strains shall be protected by law.

第二十條   轉基因畜禽品種的培育、試驗、審定和推廣，應當符合國家有關農業轉基因生物管理的規定。

Article 20 The breeding, experiment, examination, approval and popularization of species of genetically modified livestock and poultry shall be in line with the provisions of the state on the administration of agricultural genetically modified organisms.

第二十一條   省級以上畜牧獸醫技術推廣機構可以組織開展種畜優良個體登記，向社會推薦優良種畜。優良種畜登記規則由國務院畜牧獸醫行政主管部門制定。

Article 21 A stockbreeding and veterinary technology popularization institution at the provincial level or above may register the fine breeding livestock and recommend fine breeding livestock to the general public. The rules on the register of breeding livestock shall be formulated by the stockbreeding and veterinary administrative department of the State Council.

第二十二條   從事種畜禽生產經營或者生產商品代仔畜、雛禽的單位、個人，應當取得種畜禽生產經營許可證。

Article 22 Any entity or individual that engages in the production and business operation of breeding livestock and poultry or in the production of young commercial livestock and poultry shall obtain a permit for the production and business operation of breeding livestock and poultry.

申請取得種畜禽生產經營許可證，應當具備下列條件：

To apply for a permit for the production and business operation of breeding livestock and poultry, an applicant shall meet the following conditions:

（一）生產經營的種畜禽必須是通過國家畜禽遺傳資源委員會審定或者鑒定的品種、配套系，或者是經批準引進的境外品種、配套系；

1. The breeding livestock and poultry for production and business operations shall fall within the species or genetic improvement system as accredited or appraised by the National Commission for Livestock and Poultry Genetic Resources, or shall fall within the species or genetic improvement system as imported from abroad upon approval;

（二）有與生產經營規模相適應的畜牧獸醫技術人員；

2. Having the stockbreeding and veterinary technicians that can meet the needs of production and business operations;

（三）有與生產經營規模相適應的繁育設施設備；

(III) Having breeding facilities and equipment that can meet the needs of production and business operations;

（四）具備法律、行政法規和國務院畜牧獸醫行政主管部門規定的種畜禽防疫條件；

(IV) Satisfying the livestock and poultry disease prevention conditions as described in the laws, administrative regulations, as well as the provisions of the stockbreeding and veterinary administrative department of the State Council;

（五）有完善的質量管理和育種記錄制度；

(V) Having perfect quality management and breeding record system; and

（六）具備法律、行政法規規定的其他條件。

(VI) Other conditions as prescribed by laws and administrative regulations.

第二十三條   申請取得生產家畜卵子、冷凍精液、胚胎等遺傳材料的生產經營許可證，除應當符合本法第二十二條第二款規定的條件外，還應當具備下列條件：

Article 23 To apply for a license for the production and business operation of ova, frozen sperms, embryos and other genetic materials, an applicant shall not only meet the conditions as prescribed in Paragraph 2 of Article 22 of this Law, but also satisfy the following requirements:

（一）符合國務院畜牧獸醫行政主管部門規定的實驗室、保存和運輸條件；

1. Meeting the requirements for laboratory, preservation and transport as provided for by the stockbreeding and veterinary administrative department of the State Council;

（二）符合國務院畜牧獸醫行政主管部門規定的種畜數量和質量要求；

(II) Meeting the number and quality requirements as provided for by the stockbreeding and veterinary administrative department of the State Council;

（三）體外授精取得的胚胎、使用的卵子來源明確，供體畜符合國家規定的種畜健康標準和質量要求；

(III) The sources of the embryos obtained from in vitro fertilization as well as the available ova are clear, and the donor livestock comply with the national health standards and quality requirements for the breeding livestock;

（四）符合國務院畜牧獸醫行政主管部門規定的其他技術要求。

(IV) meeting other technical requirements as provided for by the stockbreeding and veterinary administrative department of the State Council.

第二十四條   申請取得生產家畜卵子、冷凍精液、胚胎等遺傳材料的生產經營許可證，應當向省級人民政府畜牧獸醫行政主管部門提出申請。受理申請的畜牧獸醫行政主管部門應當自收到申請之日起六十個工作日內依法決定是否發給生產經營許可證。

Article 24 To obtain a permit for the production and business operations of ova, frozen sperms, embryos and other genetic materials of livestock, an applicant shall file an application with the stockbreeding and veterinary administrative department of the provincial people's government. The said department that accepts the application shall, within 60 working days from the date it receives the application, make a decision, in accordance with law, on whether to issue such a license.

其他種畜禽的生產經營許可證由縣級以上地方人民政府畜牧獸醫行政主管部門審核發放，具體審核發放辦法由省級人民政府規定。

The permits for the production and business operation of other breeding livestock and poultry shall be issued by the stockbreeding and veterinary administrative departments of the people's governments at the county level or above upon examination and approval. The concrete examination, approval and issuance measures shall be provided for by the provincial people's governments.

種畜禽生產經營許可證樣式由國務院畜牧獸醫行政主管部門制定，許可證有效期為三年。發放種畜禽生產經營許可證可以收取工本費，具體收費管理辦法由國務院財政、價格部門制定。

The specimen of the license for the production and business operation of breeding livestock and poultry shall be formulated by the stockbreeding and veterinary administrative department of the State Council. A license shall be valid for 3 years. A production fee may be charged for the issuance of the license for the production and business operation of breeding livestock and poultry. The concrete fee-charging measures shall be formulated by the public finance or price department of the State Council.

第二十五條   種畜禽生產經營許可證應當注明生產經營者名稱、場（廠）址、生產經營範圍及許可證有效期的起止日期等。

Article 25 A license for the production and business operation of breeding livestock and poultry shall indicate the name of the producer/business operator, farm (factory) site, production and business scope as well as the beginning date and ending date of the valid term of the license.

禁止任何單位、個人無種畜禽生產經營許可證或者違反種畜禽生產經營許可證的規定生產經營種畜禽。禁止偽造、變造、轉讓、租借種畜禽生產經營許可證。

It is forbidden for any entity or individual to engage in the production or business operation of breeding livestock or poultry without a permit for the production and business operation of breeding livestock and poultry or by violating the permit for the production and business operation of breeding livestock and poultry. It is forbidden to forge, alter, transfer or lease the license for the production and business operation of breeding livestock and poultry.

第二十六條   農戶飼養的種畜禽用於自繁自養和有少量剩餘仔畜、雛禽出售的，農戶飼養種公畜進行互助配種的，不需要辦理種畜禽生產經營許可證。

Article 26 Where a farmer raises breeding livestock or poultry by himself and has a small number of young livestock or poultry for sale, or raises male breeding livestock and carries out the mating on a mutual help basis, the license for the production and business operation of breeding livestock and poultry is not required.

第二十七條   專門從事家畜人工授精、胚胎移植等繁殖工作的人員，應當取得相應的國家職業資格證書。

Article 27 Anyone who specially engages in such breeding jobs as the external insemination and embryo implantation shall obtain the corresponding professional qualification certificate.

第二十八條   發布種畜禽廣告的，廣告主應當提供種畜禽生產經營許可證和營業執照。廣告內容應當符合有關法律、行政法規的規定，並注明種畜禽品種、配套系的審定或者鑒定名稱；對主要性狀的描述應當符合該品種、配套系的標準。

Article 28 To release any livestock or poultry advertisement, the advertiser shall provide the license for the production and business operation of breeding livestock and poultry as well as the business license. The contents of the advertisement shall be in line with the relevant laws and administrative regulations, and the name or title of the verifier or identifier for the breeds of the breeding livestock and poultry and the synthetic strains shall be indicated. The descriptions of their main characters shall be in line with the standards for such breeds and synthetic strains.

第二十九條   銷售的種畜禽和家畜配種站（點）使用的種公畜，必須符合種用標準。銷售種畜禽時，應當附具種畜禽場出具的種畜禽合格證明、動物防疫監督機構出具的檢疫合格證明，銷售的種畜還應當附具種畜禽場出具的家畜系譜。

Article 29 The breeding livestock and poultry for sale, and the available male breeding livestock of the livestock mating stations (places) shall comply with the standards on the breeds. When any breeding livestock or poultry are sold, they shall be accompanied by a conformity certificate issued by the breeding livestock or poultry farm and a quarantine certificate issued by the animal epidemic prevention and supervisory institution. Moreover, any breeding livestock for sale shall be accompanied by the domestic animal pedigree issued by the breeding livestock or poultry farm.

生產家畜卵子、冷凍精液、胚胎等遺傳材料，應當有完整的采集、銷售、移植等記錄，記錄應當保存二年。

A producer of ova, frozen sperms, embryos and other genetic materials of livestock shall have complete gathering, sale and transplant records and shall preserve these records for two years.

第三十條   銷售種畜禽，不得有下列行為：

Article 30 No seller of breeding stock and poultry may sell:

（一）以其他畜禽品種、配套系冒充所銷售的種畜禽品種、配套系；

1. any variety or genetic improvement system of the breeding livestock or poultry as other varieties or genetic improvement system of livestock or poultry;

（二）以低代別種畜禽冒充高代別種畜禽；

2. any inferior generation of livestock or poultry as superior one;

（三）以不符合種用標準的畜禽冒充種畜禽；

(III) any livestock or poultry that do not meet the standards on the breeding livestock or poultry as breeding livestock or poultry;

（四）銷售未經批準進口的種畜禽；

(IV) any breeding livestock or poultry imported without approval;

（五）銷售未附具本法第二十九條規定的種畜禽合格證明、檢疫合格證明的種畜禽或者未附具家畜系譜的種畜；

(V) any livestock and poultry not accompanied by a conformity certificate and quarantine certificate as required by Article 29 of this Law or any breeding livestock not accompanied by the pedigree of the livestock; or

（六）銷售未經審定或者鑒定的種畜禽品種、配套系。

(VI) any species of livestock or poultry, or genetic improvement system that has not been examined, approved or appraised.

第三十一條   申請進口種畜禽的，應當持有種畜禽生產經營許可證。進口種畜禽的批準文件有效期為六個月。

Article 31 To apply for the import of any breeding livestock or poultry, an applicant shall hold a permit for the production and business operation of breeding livestock and poultry. The approval documents concerning the import of breeding livestock and poultry shall be valid for 6 months.

進口的種畜禽應當符合國務院畜牧獸醫行政主管部門規定的技術要求。首次進口的種畜禽還應當由國家畜禽遺傳資源委員會進行種用性能的評估。

The imported breeding livestock and poultry shall meet the technical requirements of the stockbreeding and veterinary administrative department of the State Council. Moreover, the initially imported breeding livestock or poultry shall be subject to the breeding performance evaluation by the National Commission for Livestock and Poultry Genetic Resources.

種畜禽的進出口管理除適用前兩款的規定外，還適用本法第十五條和第十六條的相關規定。

Apart from the two preceding paragraphs, the relevant provisions of Articles 15 and 16 of this Law shall be applicable to the administration of the import and export of breeding livestock and poultry as well.

國家鼓勵畜禽養殖者對進口的畜禽進行新品種、配套系的選育；選育的新品種、配套系在推廣前，應當經國家畜禽遺傳資源委員會審定。

The State encourages the breeders of livestock and poultry to conduct selective breeding of new breeds and the synthetic strains of the imported livestock and poultry; before such new breeds and synthetic strains for selective breeding are used on a broad scale, they shall be subject to verification by the National Commission for Livestock and Poultry Genetic Resources.

第三十二條   種畜禽場和孵化場（廠）銷售商品代仔畜、雛禽的，應當向購買者提供其銷售的商品代仔畜、雛禽的主要生產性能指標、免疫情況、飼養技術要求和有關諮詢服務，並附具動物防疫監督機構出具的檢疫合格證明。

Article 32 Where a breeding livestock or poultry farm or incubation farm (factory) sells young commercial livestock and poultry, it shall offer to the buyers the main indicators of their performances, disease immunity information, breeding technical requirements and relevant consultation services, and shall attach to it a quarantine certificate issued by the animal disease prevention and supervisory institution.

銷售種畜禽和商品代仔畜、雛禽，因質量問題給畜禽養殖者造成損失的，應當依法賠償損失。

Where a seller of breeding livestock, breeding poultry, young commercial livestock or young commercial poultry causes any loss to a breeder of livestock or poultry due to the reason of quality, he shall compensate for such loss according to law.

第三十三條   縣級以上人民政府畜牧獸醫行政主管部門負責種畜禽質量安全的監督管理工作。種畜禽質量安全的監督檢驗應當委托具有法定資質的種畜禽質量檢驗機構進行；所需檢驗費用按照國務院規定列支，不得向被檢驗人收取。

Article 33 The stockbreeding and veterinary administrative departments of the people's governments at or above the county level shall be responsible for the supervision and administration over the quality and safety of breeding livestock and poultry. The supervision over and inspection of the quality and safety of breeding livestock and poultry shall be entrusted to the breeding livestock and poultry quality inspection institutions with statutory qualifications. The necessary inspection expenses shall be listed as expenditures according to the provisions of the State Council, which shall not be paid by the inspected parties.

第三十四條   蠶種的資源保護、新品種選育、生產經營和推廣適用本法有關規定，具體管理辦法由國務院農業行政主管部門制定。

Article 34 The relevant provisions of this Law apply to the resource protection, selective breeding of new varieties, production, business operation and popularization of breeding silkworms. The specific administrative measures shall be formulated by the agriculture administrative department of the State Council.

第四章 畜禽養殖

Chapter 4 Breeding of Livestock and Poultry

第三十五條   縣級以上人民政府畜牧獸醫行政主管部門應當根據畜牧業發展規劃和市場需求，引導和支持畜牧業結構調整，發展優勢畜禽生產，提高畜禽產品市場競爭力。

Article 35 A stockbreeding and veterinary administrative department of the people's government at the county level or above shall, according to the stockbreeding development plan and market demands, guide and support the structural adjustment of stockbreeding, develop the livestock and poultry production with advantages and enhance the market competitiveness of livestock and poultry products.

國家支持草原牧區開展草原圍欄、草原水利、草原改良、飼草飼料基地等草原基本建設，優化畜群結構，改良牲畜品種，轉變生產方式，發展舍飼圈養、劃區輪牧，逐步實現畜草平衡，改善草原生態環境。

The state shall support the grassland pastoral areas to carry out such basic construction as pasture fencing, water conservancy, pasture improvement, and forage and feed bases, optimize the structure of livestock herds, improve the species of livestock, change the production method, develop penned animal feeding and rotational grazing, gradually realize the balance between the livestock and forage and improve the ecological environment of the pastures.

第三十六條   國務院和省級人民政府應當在其財政預算內安排支持畜牧業發展的良種補貼、貼息補助等資金，並鼓勵有關金融機構通過提供貸款、保險服務等形式，支持畜禽養殖者購買優良畜禽、繁育良種、改善生產設施、擴大養殖規模，提高養殖效益。

Article 36 The State Council and the provincial people's governments shall, within their respective financial budget, arrange the fine breed subsidies, interest discount subsidies and other fund for supporting the stockbreeding development, shall encourage the pertinent financial institutions, by way of providing loans, insurance services, etc., to support the livestock and poultry breeders to buy fine breeds of livestock and poultry, breed fine breeds, improve the production facilities, expand the breeding scale and promote breeding benefits.

第三十七條   國家支持農村集體經濟組織、農民和畜牧業合作經濟組織建立畜禽養殖場、養殖小區，發展規模化、標準化養殖。鄉（鎮）土地利用總體規劃應當根據本地實際情況安排畜禽養殖用地。農村集體經濟組織、農民、畜牧業合作經濟組織按照鄉（鎮）土地利用總體規劃建立的畜禽養殖場、養殖小區用地按農業用地管理。畜禽養殖場、養殖小區用地使用權期限屆滿，需要恢複為原用途的，由畜禽養殖場、養殖小區土地使用權人負責恢複。在畜禽養殖場、養殖小區用地範圍內需要興建永久性建（構）築物，涉及農用地轉用的，依照《中華人民共和國土地管理法》的規定辦理。

Article 37 The state shall support the rural collective economic organizations, farmers and stockbreeding cooperative economic organizations to establish livestock and poultry farms or areas, develop scale and standardized breeding. The overall plan of a town (township) on land utilization shall arrange for the land available for livestock and poultry breeding in light of the local conditions. The livestock and poultry farms and areas established by the rural collective economic organizations and farmer according to the overall plan of a town (township) on land utilization shall be managed according to agricultural land. When the land use period of a livestock or poultry farm or raising community expires, if it is necessary to restore the original purpose of the land, the holder of the right to use the land of the livestock or poultry farm or raising community shall be responsible for restoring it to its original use. Where it is necessary to establish any permanent building (fixture) which involves the change of the purpose of the agricultural land, the relevant provisions of the Land Administration Law of the People's Republic of China shall apply.

第三十八條   國家設立的畜牧獸醫技術推廣機構，應當向農民提供畜禽養殖技術培訓、良種推廣、疫病防治等服務。縣級以上人民政府應當保障國家設立的畜牧獸醫技術推廣機構從事公益性技術服務的工作經費。

Article 38 The stockbreeding and veterinary technology popularization institutions established by the state shall offer to farmers livestock and poultry breeding technology training, extension of fine breeds, disease prevention and control, and other services. The people's government at or above the county level shall ensure the fund for the stockbreeding and veterinary technology popularization institutions established by the state to engage in the technical services for public interest.

國家鼓勵畜禽產品加工企業和其他相關生產經營者為畜禽養殖者提供所需的服務。

The State encourages enterprises processing livestock and poultry products and other producers and operators in this area to provide services needed by the breeders of livestock and poultry.

第三十九條   畜禽養殖場、養殖小區應當具備下列條件：

Article 39 A livestock, poultry farm or raising community shall meet the following conditions:

（一）有與其飼養規模相適應的生產場所和配套的生產設施；

1. Having a production site and production facilities commensurate with the needs of the raising scale;

（二）有為其服務的畜牧獸醫技術人員；

(II) Having animal husbandry and veterinary technicians who serve it;

（三）具備法律、行政法規和國務院畜牧獸醫行政主管部門規定的防疫條件；

(III) Meeting the requirements of epidemic prevention as prescribed by the laws, administrative regulations, as well as the provisions of the stockbreeding and veterinary administrative department of the State Council;

（四）有對畜禽糞便、廢水和其他固體廢棄物進行綜合利用的沼氣池等設施或者其他無害化處理設施；

(IV) Having facilities such as firedamp pool for the comprehensive utilization of the livestock or poultry dung, waste water and other solid wastes, or having other innocuous disposal facilities;

（五）具備法律、行政法規規定的其他條件。

(V) Other conditions as prescribed by laws and administrative regulations.

養殖場、養殖小區興辦者應當將養殖場、養殖小區的名稱、養殖地址、畜禽品種和養殖規模，向養殖場、養殖小區所在地縣級人民政府畜牧獸醫行政主管部門備案，取得畜禽標識代碼。

The owner of the aforesaid farm or raising community shall report the name and address of the farm or raising community, species of the livestock or poultry as well as the raising scale to the stockbreeding and veterinary administrative department of the people's government at the county level at its locality for the record so as to obtain the code of livestock or poultry mark.

省級人民政府根據本行政區域畜牧業發展狀況制定畜禽養殖場、養殖小區的規模標準和備案程序。

People's governments at the provincial level shall, in light of the development of animal husbandry within their respective administrative areas, formulate standards on the scales of livestock and poultry farms or raising areas as well as the procedures of keeping records.

第四十條   禁止在下列區域內建設畜禽養殖場、養殖小區：

Article 40 No livestock or poultry farm or raising community may be built in any of the following areas:

（一）生活飲用水的水源保護區，風景名勝區，以及自然保護區的核心區和緩沖區；

1. The water source protection areas of drinking water, scenic spots and historical sites, as well as the core areas and buffer areas of natural protection areas;

（二）城鎮居民區、文化教育科學研究區等人口集中區域；

(II) Urban residential areas, cultural, educational and scientific research areas, and other population intensive areas; or

（三）法律、法規規定的其他禁養區域。

(III) Other areas banned by laws or regulations.

第四十一條   畜禽養殖場應當建立養殖檔案，載明以下內容：

Article 41 A livestock and poultry farm shall establish raising archives, which shall contain:

（一）畜禽的品種、數量、繁殖記錄、標識情況、來源和進出場日期；

1. the species, number, reproduction records, mark information, sources, and dates of entering and exiting the farm;

（二）飼料、飼料添加劑、獸藥等投入品的來源、名稱、使用對象、時間和用量；

2. the source, name, object, time, quantity of the feed, feed additives, veterinary drugs, etc.;

（三）檢疫、免疫、消毒情況；

(III) the conditions of quarantine, immunity and sterilization;

（四）畜禽發病、死亡和無害化處理情況；

4. information on the attack of diseases, death and innocuous disposal of the livestock or poultry after the attach of the diseases;

（五）國務院畜牧獸醫行政主管部門規定的其他內容。

(V) other contents as required by the stockbreeding and veterinary administrative department of the State Council.

第四十二條   畜禽養殖場應當為其飼養的畜禽提供適當的繁殖條件和生存、生長環境。

Article 42 A livestock and poultry farm shall provide its livestock or poultry with a proper reproduction, living and growth environment.

第四十三條   從事畜禽養殖，不得有下列行為：

Article 43 No breeder of livestock or poultry may:

（一）違反法律、行政法規的規定和國家技術規範的強制性要求使用飼料、飼料添加劑、獸藥；

1. using any feed, feed additive or animal drug in violation of laws, administrative regulations, or mandatory requirements of the national technical norms;

（二）使用未經高溫處理的餐館、食堂的泔水飼喂家畜；

2. feed any restaurant or eatery swill untreated by high temperature to the livestock;

（三）在垃圾場或者使用垃圾場中的物質飼養畜禽；

3. raise the livestock or poultry in a refuse dump or feed the substances of refuse dump to the livestock or poultry;

（四）法律、行政法規和國務院畜牧獸醫行政主管部門規定的危害人和畜禽健康的其他行為。

(IV) commit other acts harmful to the health of human, livestock and poultry as provided in the laws, administrative regulations, and provisions of the stockbreeding and veterinary administrative department of the State Council.

第四十四條   從事畜禽養殖，應當依照《中華人民共和國動物防疫法》的規定，做好畜禽疫病的防治工作。

Article 44 A breeder of livestock and poultry shall, under the Law of the People's Republic of China on Animal Epidemic Prevention, do a good job in the prevention and control of livestock and poultry diseases.

第四十五條   畜禽養殖者應當按照國家關於畜禽標識管理的規定，在應當加施標識的畜禽的指定部位加施標識。畜牧獸醫行政主管部門提供標識不得收費，所需費用列入省級人民政府財政預算。

Article 45 A livestock and poultry breeder shall, according to the provisions of the state on the administration of livestock and poultry marks, put a mark at the designated part of the livestock or poultry. No stockbreeding and veterinary administrative department may charge any fee for provision of such marks. The necessary expenses for such marks shall be listed into the fiscal budget of the provincial people's government.

畜禽標識不得重複使用。

No livestock or poultry mark may be used repeatedly.

第四十六條   畜禽養殖場、養殖小區應當保證畜禽糞便、廢水及其他固體廢棄物綜合利用或者無害化處理設施的正常運轉，保證汙染物達標排放，防止汙染環境。

Article 46 A livestock and poultry farm or raising community shall ensure the normal running of the facilities for comprehensive utilization or other innocuous disposal of the livestock or poultry dung, waste water and other solid wastes so as to make the discharge of pollutants come up to the relevant standards and prevent environmental pollution.

畜禽養殖場、養殖小區違法排放畜禽糞便、廢水及其他固體廢棄物，造成環境汙染危害的，應當排除危害，依法賠償損失。

Where a livestock and poultry farm or raising community illegally discharges the feces of livestock and poultry, waste water and other solid wastes, thus causing environmental pollution, it shall eliminate the pollution and compensate for the losses according to law.

國家支持畜禽養殖場、養殖小區建設畜禽糞便、廢水及其他固體廢棄物的綜合利用設施。

The state shall support the livestock and poultry farms or raising areas to build the facilities for comprehensive utilization of livestock or poultry dung, waste water and other solid wastes.

第四十七條   國家鼓勵發展養蜂業，維護養蜂生產者的合法權益。

Article 47 The State encourages the development of apiculture and protects the lawful rights and interests of bee-keepers.

有關部門應當積極宣傳和推廣蜜蜂授粉農藝措施。

The relevant departments shall, on their initiatives, publicize and popularize the agricultural techniques of bee pollination.

第四十八條   養蜂生產者在生產過程中，不得使用危害蜂產品質量安全的藥品和容器，確保蜂產品質量。養蜂器具應當符合國家技術規範的強制性要求。

Article 48 During the course of production, no apiculturist may use any drug or container that may affect the quality and safety of bee-related products so as to guarantee the quality of bee-related products. Utensils for beekeeping shall meet the compulsory requirements of the technical specifications prescribed by the State.

第四十九條   養蜂生產者在轉地放蜂時，當地公安、交通運輸、畜牧獸醫等有關部門應當為其提供必要的便利。

Article 49 When an apiculturist undertakes honey campaigns in different places, the local departments of public security, traffic and transport, and stock breeding and veterinary shall provide him with necessary conveniences.

養蜂生產者在國內轉地放蜂，憑國務院畜牧獸醫行政主管部門統一格式印制的檢疫合格證明運輸蜂群，在檢疫合格證明有效期內不得重複檢疫。

Where an apiculturist undertakes honey campaigns in different places within the country, he shall, upon the quarantine certificate printed and produced by the stockbreeding and veterinary administrative department of the State Council under the uniform format, transport the bee flocks, which shall not be quarantined repeatedly within the valid period of the quarantine certificate.

第五章 畜禽交易與運輸

Chapter 5 Trading in and Transportation of Livestock and Poultry

第五十條   縣級以上人民政府應當促進開放統一、競爭有序的畜禽交易市場建設。

Article 50 The people's governments at or above the county level shall promote the construction of an open, uniform, competitive and orderly livestock and poultry market.

縣級以上人民政府畜牧獸醫行政主管部門和其他有關主管部門應當組織搜集、整理、發布畜禽產銷信息，為生產者提供信息服務。

The stockbreeding and veterinary administrative departments and other relevant competent departments of the people's governments at or above the county level shall organize to collect, arrange and release the livestock and poultry production and sale information so as to provide the producers with information services.

第五十一條   縣級以上地方人民政府根據農產品批發市場發展規劃，對在畜禽集散地建立畜禽批發市場給予扶持。

Article 51 The local people's government at the county level or above shall, according to its plan on the development of wholesale markets of agricultural products, support the establishment of livestock and poultry markets at the livestock and poultry distribution place.

畜禽批發市場選址，應當符合法律、行政法規和國務院畜牧獸醫行政主管部門規定的動物防疫條件，並距離種畜禽場和大型畜禽養殖場三公裡以外。

The selected location of a livestock and poultry wholesale market shall meet the animal disease prevention conditions as described in the laws, administrative regulations, and the provisions of the stockbreeding and veterinary administrative department of the State Council and there shall be a distance of 3 kilometers or more from any breeding livestock and poultry farm and large livestock and poultry farm.

第五十二條   進行交易的畜禽必須符合國家技術規範的強制性要求。

Article 52 The livestock and poultry for transaction shall meet the compulsory requirements of the national technical norms.

國務院畜牧獸醫行政主管部門規定應當加施標識而沒有標識的畜禽，不得銷售和收購。

No one may sell or buy any livestock or poultry which have not been given a mark as required by the stockbreeding and veterinary administrative department of the State Council.

第五十三條   運輸畜禽，必須符合法律、行政法規和國務院畜牧獸醫行政主管部門規定的動物防疫條件，采取措施保護畜禽安全，並為運輸的畜禽提供必要的空間和飼喂飲水條件。

Article 53 The transport of livestock and poultry shall meet the animal disease prevention requirements as described in the laws, administrative regulations, and provisions of the stockbreeding and veterinary administrative department of the State Council, take measures to protect the safety of livestock and poultry and shall provide necessary room and feeding and drinking conditions for the transported livestock and poultry.

有關部門對運輸中的畜禽進行檢查，應當有法律、行政法規的依據。

Inspection of livestock and poultry conducted in the course of transportation by the relevant departments shall be based on laws and administrative regulations.

第六章 質量安全保障

Chapter 6 Quality and Safety Guarantee

第五十四條   縣級以上人民政府應當組織畜牧獸醫行政主管部門和其他有關主管部門，依照本法和有關法律、行政法規的規定，加強對畜禽飼養環境、種畜禽質量、飼料和獸藥等投入品的使用以及畜禽交易與運輸的監督管理。

Article 54 The people's government at or above the county level shall organize the stockbreeding and veterinary administrative department and other relevant competent departments to strengthen the supervision and management of the livestock and poultry raising environment, breeding livestock and poultry quality, use of feed, animal drug and other substances, as well as the livestock and poultry transactions and transport in accordance with this Law and other relevant laws and administrative regulations.

第五十五條   國務院畜牧獸醫行政主管部門應當制定畜禽標識和養殖檔案管理辦法，采取措施落實畜禽產品質量責任追究制度。

Article 55 The stockbreeding and veterinary administrative department of the State Council shall formulate measures for the administration of livestock and poultry marks and raising archives and take measures to carry out the livestock and poultry product quality responsibility system.

第五十六條   縣級以上人民政府畜牧獸醫行政主管部門應當制定畜禽質量安全監督檢查計劃，按計劃開展監督抽查工作。

Article 56 The stockbreeding and veterinary administrative departments of the people's governments at or above the county level shall make plans on the supervision and inspection over the quality and safety of livestock and poultry, and shall carry out the planed supervision and spot-checking tasks.

第五十七條   省級以上人民政府畜牧獸醫行政主管部門應當組織制定畜禽生產規範，指導畜禽的安全生產。

Article 57 The stockbreeding and veterinary administrative departments of the people's governments at or above the provincial level shall formulate livestock and poultry production norms to guide the safe production of livestock and poultry.

第七章 法律責任

Chapter 7 Legal Liabilities

第五十八條   違反本法第十三條第二款規定，擅自處理受保護的畜禽遺傳資源，造成畜禽遺傳資源損失的，由省級以上人民政府畜牧獸醫行政主管部門處五萬元以上五十萬元以下罰款。

Article 58 Where anyone disposes any livestock or poultry genetic resource under protection by violating Paragraph 2 of Article 13 of this Law, if it (he) causes any loss to the livestock or poultry genetic resource, it (he) shall be fined not less than CNY50,000 but not more than CNY500,000 by the stockbreeding and veterinary administrative department of the people's government at the province level or above.

第五十九條   違反本法有關規定，有下列行為之一的，由省級以上人民政府畜牧獸醫行政主管部門責令停止違法行為，沒收畜禽遺傳資源和違法所得，並處一萬元以上五萬元以下罰款：

Article 59 Where anyone who commits any of the following acts by violating the relevant provisions of this Law, the stockbreeding and veterinary administrative department of the people's government at the province level or above shall order it (him) to stop the violation, shall confiscate the livestock or poultry genetic resource and the illegal gains and shall fine it (him) not less than CNY10,000 but not more than CNY50,000:

（一）未經審核批準，從境外引進畜禽遺傳資源的；

1. importing any livestock or poultry genetic resource from abroad without examination and approval;

（二）未經審核批準，在境內與境外機構、個人合作研究利用列入保護名錄的畜禽遺傳資源的；

(II) Cooperating with any foreign institution or individual in the China-based research or utilization of any of livestock or poultry genetic resources included in the protection list;

（三）在境內與境外機構、個人合作研究利用未經國家畜禽遺傳資源委員會鑒定的新發現的畜禽遺傳資源的。

(III) Cooperating with any foreign institution or individual in the China-based research or utilization of any newly discovered livestock or poultry genetic resource that has not been appraised by the National Commission for Livestock and Poultry Genetic Resources.

第六十條   未經國務院畜牧獸醫行政主管部門批準，向境外輸出畜禽遺傳資源的，依照《中華人民共和國海關法》的有關規定追究法律責任。海關應當將扣留的畜禽遺傳資源移送省級人民政府畜牧獸醫行政主管部門處理。

Article 60 Without approval of the stockbreeding and veterinary administrative department of the State Council, anyone who exports any livestock or poultry genetic resource from China shall bear the legal liabilities according to the relevant provisions of the Customs Law of the People's Republic of China. The Customs shall transfer the detained livestock or poultry resource to the stockbreeding and veterinary administrative department of the provincial people's government for disposal.

第六十一條   違反本法有關規定，銷售、推廣未經審定或者鑒定的畜禽品種的，由縣級以上人民政府畜牧獸醫行政主管部門責令停止違法行為，沒收畜禽和違法所得；違法所得在五萬元以上的，並處違法所得一倍以上三倍以下罰款；沒有違法所得或者違法所得不足五萬元的，並處五千元以上五萬元以下罰款。

Article 61 Where, in violation of the relevant provisions of this Law, an entity sells or spreads the use of the strains of livestock and poultry that have not undergone verification or identification, the administrative department for animal husbandry and veterinary medicine under the people's government at or above the county level shall order it to discontinue the illegal act and confiscate the livestock and poultry and the illegal gains therefrom; if the illegal gains exceed 50,000 yuan, it shall, in addition, be fined not less than one time but not more than three times the illegal gains; and if there are no illegal gains or the illegal gains are less than 50,000 yuan, it shall, in addition, be fined not less than 5,000 yuan but not more than 50,000 yuan.

第六十二條   違反本法有關規定，無種畜禽生產經營許可證或者違反種畜禽生產經營許可證的規定生產經營種畜禽的，轉讓、租借種畜禽生產經營許可證的，由縣級以上人民政府畜牧獸醫行政主管部門責令停止違法行為，沒收違法所得；違法所得在三萬元以上的，並處違法所得一倍以上三倍以下罰款；沒有違法所得或者違法所得不足三萬元的，並處三千元以上三萬元以下罰款。違反種畜禽生產經營許可證的規定生產經營種畜禽或者轉讓、租借種畜禽生產經營許可證，情節嚴重的，並處吊銷種畜禽生產經營許可證。

Article 62 Where anyone, in violation of this Law, engages in the production and business operation of breeding livestock or poultry without a permit for the production and business operation of breeding livestock and poultry or by violating the provisions of the permit for the production and business operation of breeding livestock and poultry, or transfers or renting any permit for the production and business operation of livestock and poultry, the stockbreeding and veterinary administrative department of the people's government at the county level or above shall order it or him to stop the violation and shall confiscate the illegal gains. If the amount of illegal gains is not less than 30, 000 Yuan, the violator shall be imposed a fine of not less than 1 time but not more than 3 times the amount of illegal gains. If there are no illegal gains or if the amount of illegal gains is less than 30, 000 Yuan, the violator shall be imposed a fine of not less than 3, 000 Yuan but not more than 30, 000 Yuan. Where anyone, in violation of the provisions of the license for the production and business operation of breeding livestock and poultry, engages in the production and business operation of breeding livestock or poultry, or transfers or leases the license for the production and business operation of breeding livestock and poultry, if the circumstance is serious, the license for the production and business operation of breeding livestock and poultry shall be revoked.

第六十三條   違反本法第二十八條規定的，依照《中華人民共和國廣告法》的有關規定追究法律責任。

Article 63 Anyone who violates the provisions of Article 28 of this Law shall bear the legal liabilities in accordance with the Advertising Law of the People's Republic of China.

第六十四條   違反本法有關規定，使用的種畜禽不符合種用標準的，由縣級以上地方人民政府畜牧獸醫行政主管部門責令停止違法行為，沒收違法所得；違法所得在五千元以上的，並處違法所得一倍以上二倍以下罰款；沒有違法所得或者違法所得不足五千元的，並處一千元以上五千元以下罰款。

Article 64 Where the breeding livestock and poultry used by an entity, in violation of the relevant provisions of this Law, do not meet the breeding standards, the administrative department for animal husbandry and veterinary medicine under the local people's government at or above the county level shall order it to discontinue the illegal act and confiscate its illegal gains therefrom; if the illegal gains exceed 5,000 yuan, it shall, in addition, be fined not less than one time but not more than two times the illegal gains; and if there are no illegal gains or the illegal gains are less than 5,000 yuan, it shall, in addition, be fined not less than 1,000 yuan but not more than 5,000 yuan.

第六十五條   銷售種畜禽有本法第三十條第一項至第四項違法行為之一的，由縣級以上人民政府畜牧獸醫行政主管部門或者工商行政管理部門責令停止銷售，沒收違法銷售的畜禽和違法所得；違法所得在五萬元以上的，並處違法所得一倍以上五倍以下罰款；沒有違法所得或者違法所得不足五萬元的，並處五千元以上五萬元以下罰款；情節嚴重的，並處吊銷種畜禽生產經營許可證或者營業執照。

Article 65 Where in selling breeding livestock and poultry, an entity commits one of the illegal acts specified in Items (1) through (4) in Article 30 of this Law, the administrative department for animal husbandry and veterinary medicine or the administrative department for industry and commerce under the people's government at or above the county level shall order it to discontinue such sale and confiscate the livestock and poultry for illegal sale and the illegal gains therefrom; if the illegal gains exceed 50,000 yuan, it shall, in addition, be fined not less than one time but not more than five times the illegal gains; if there are no illegal gains or the illegal gains are less than 50,000 yuan, it shall, in addition, be fined not less than 5,000 yuan but not more than 50,000 yuan; and if the circumstances are serious, its license for production and operation of the breeding livestock and poultry or its business license shall, in addition, be revoked.

第六十六條   違反本法第四十一條規定，畜禽養殖場未建立養殖檔案的，或者未按照規定保存養殖檔案的，由縣級以上人民政府畜牧獸醫行政主管部門責令限期改正，可以處一萬元以下罰款。

Article 66 Where livestock or poultry farm, in violation of Article 41 of this Law, fails to establish raising archives or fails to preserve the raising archives according to the relevant provisions, the stockbreeding and veterinary administrative department of the people's government at the county level or above shall order it to make corrections within a time limit and may fine it CNY10,000 or less.

第六十七條   違反本法第四十三條規定養殖畜禽的，依照有關法律、行政法規的規定處罰。

Article 67 Anyone who raises any livestock or poultry by violating Article 43 of this Law shall be punished in accordance with the relevant laws and administrative regulations.

第六十八條   違反本法有關規定，銷售的種畜禽未附具種畜禽合格證明、檢疫合格證明、家畜系譜的，銷售、收購國務院畜牧獸醫行政主管部門規定應當加施標識而沒有標識的畜禽的，或者重複使用畜禽標識的，由縣級以上地方人民政府畜牧獸醫行政主管部門或者工商行政管理部門責令改正，可以處二千元以下罰款。

Article 68 Where anyone who, in violation of this law, sells any breeding livestock or poultry without attaching to them the breeding livestock or poultry conformity certificates, quarantine certificates or livestock genealogy, or sells or buys any livestock or poultry which shall bear marks as required by the stockbreeding and veterinary administrative department of the State Council, or uses any livestock or poultry mark repeatedly, it (he) shall be ordered to make corrections and may be fined CNY2,000 or less by the stockbreeding and veterinary administrative department or administrative department for industry and commerce of the local people's government at or above the county level.

違反本法有關規定，使用偽造、變造的畜禽標識的，由縣級以上人民政府畜牧獸醫行政主管部門沒收偽造、變造的畜禽標識和違法所得，並處三千元以上三萬元以下罰款。

Where anyone who, in violation of this Law, uses any counterfeit or altered livestock or poultry marks, the stockbreeding and veterinary administrative department of the local people's government at the county level or above shall confiscate the counterfeit or altered livestock or poultry marks as well as the illegal gains and shall fine the violator not less than CNY3,000 but not more than CNY30,000.

第六十九條   銷售不符合國家技術規範的強制性要求的畜禽的，由縣級以上地方人民政府畜牧獸醫行政主管部門或者工商行政管理部門責令停止違法行為，沒收違法銷售的畜禽和違法所得，並處違法所得一倍以上三倍以下罰款；情節嚴重的，由工商行政管理部門並處吊銷營業執照。

Article 69 Where anyone sells any livestock or poultry that do not meet the mandatory requirements of the national technical norms, the stockbreeding and veterinary administrative department or administrative department for industry and commerce of the local people's government at or above the county level shall order it or him to stop the violation, confiscate the livestock and poultry illegally sold as well as the illegal gains and impose upon it or him a fine of not less than 1 time but not more than 3 times the illegal gains. If the circumstance is serious, the administrative department for industry and commerce shall revoke its or his business license.

第七十條   畜牧獸醫行政主管部門的工作人員利用職務上的便利，收受他人財物或者謀取其他利益，對不符合法定條件的單位、個人核發許可證或者有關批準文件，不履行監督職責，或者發現違法行為不予查處的，依法給予行政處分。

Article 70 Where a staff member of the administrative department for animal husbandry and veterinary medicine, taking advantage of his position, accepts money or things of value given by another person or seeks other benefits, issues licenses or relevant approval documents to units or individuals that do not meet the statutory conditions, fails to perform his supervisory duties, or fails to investigate and deal with violations discovered, he shall be given an administrative sanction according to law.

第七十一條   違反本法規定，構成犯罪的，依法追究刑事責任。

Article 71 Where a violation of the provisions of this Law constitutes a criminal offence, criminal liability shall be pursued in accordance with the law.

第八章 附則

Chapter 8 Supplementary Provisions

第七十二條   本法所稱畜禽遺傳資源，是指畜禽及其卵子（蛋）、胚胎、精液、基因物質等遺傳材料。

Article 72 For the purposes of this Law, genetic resources of livestock and poultry mean such genetic material as livestock and poultry and their ova (eggs), embryos, sperms and gene substances.

本法所稱種畜禽，是指經過選育、具有種用價值、適於繁殖後代的畜禽及其卵子（蛋）、胚胎、精液等。

For the purposes of this Law, the term "breeding livestock and poultry" shall refer to the selected livestock and poultry and their ova (eggs), embryos and sperms that are valuable and suitable to produce offspring.

第七十三條   本法自2006年7月1日起施行。

Article 73. This Law shall be effective 1 July 2006.
